Re: Tax

The "plain meaning" rule is long discredited or, more exactly, subject to exceptions. The whole point of technical memoranda is to explain what each side meant when it agreed to wording. I spent...

Re: Tax

I have spent some time on this issue today and conclude there can't be any definitive reply. In part I base this on experience and education (neither of which I need go into here since this note...

Re: Staying in France after 6 months

I suspect the issue is over obligation to pay French social charges, which can be substantial. This page and other pages on the site may help:...

Re: help with the language

Indeed. My grad school mentor at the Belgian uni where I was studying railed against students who photocopy with abandon, never read the stuff, and presume that they know the content just by having...

Re: Tax

I have read through the cited thread. Too many newspaper columnists and bloggers to count have reported on the inconsistent answers of IRS call centre personnel to give credence to what they are...

Re: Tax

The IRS can be gratuitously nasty. I recall a tax inspector I was dealing with at the (then) Inland Revenue opining that even he thought the IRS was a bunch of gangbuster cowboys. Google the Charlie...

Re: Tax

I take your point. But the tax difference might be small, but could lead to a problem I would rather avoid: the IRS arguing that I need not/ought not have paid tax to the UK or the other country....

Re: Tax

I am not telling anybody else what to do, and of course errors on my part might slip below the radar. But at the time I researched it and discussed it with others, I thought we understood the Treaty...

Re: Tax

I remember now that the $900 figure came from one of the annual statements from the SSA predicting what I was eligible for. Since I was not covered by SSA for many years (more than ten, but most of...

Re: Tax

It has been said that the US may tax Social Security and UK State Pension after the UK has taxed it (presumably meaning with credit for tax paid). In another forum for tax experts we have discussed...

Re: US Social Security Query

US earnings are reported for Social Security purposes on a quarterly basis, with Form 941 http://www.irs.gov/pub/irs-pdf/f941.pdf Discrepancies and omissions of SS numbers don't matter much, because...

Re: Tax

The Department of Work and Pensions pays US residents their UK State Pension in US dollars, unless a UK account is given for the purpose.

It is correct that all State pensions are taxable (under...

Re: Brit moving to Switzerland

The English law of domicile is arcane, quaint, and dangerous. It is true that one's domicile of origin (the domicile of one's father at his/her birth) is difficult to divest oneself of. But marriage...

Re: Capital Gains on property left in UK on return

One can't predict the future of taxation. This is why it's so important to have a professional advisor, which was my main point.

The issue of offshore companies owning UK property raises a special...

Re: Capital Gains on property left in UK on return

That is correct. Nonresidents of the UK do not pay CGT on UK property; this is something of an anomaly as compared with other countries of the world. And the last Budget closed a further loophole...

Re: Bringing UK car to Europe - questions

We have used UK-registered vehicles in Europe for years. In general (i.e. in most countries) it's only legal without local registration for the first 12 months of your...
