ooh....I do believe I-140 was filed in October 2011 but he didn't get Advance Parole before he left :ohmy:

Exactly. That's why I feel so aggrieved that there are probably many people still here in the US who shouldn't be, yet my son did everything openly and with honesty and he can't come back.

Not sure where I posted those details, but here's how it is.....

Arrived September 1st 2010 on initial L1 for one year.
Renewal applied for in August 2011 but only received in October 2011,...

Yes, you're right. However, L1 is a dual intent visa. And his employer had already filed an I-140 petition which is (or was) pending at the time they left.
Guess that's out the window now as well :(...

Oh no, nothing like that. I'm an RN and my husband is a retired Paramedic.

We came here in 2006 prior to the Schedule A visa category becoming retrogressed. I was sponsored by my employer.

Thanks Rene. It's L1 and L2 visas, in their second year, first renewal was granted about 6 months ago.

I've been doing a search on "cancelled without prejudice" and note some people have entered...

Another update......

Royal Mail tracking is showing package is in transit and will be delivered by January 3rd.

So, it would seem the passports are on their way but we don't actually know if...

A little update....

The Consular Officer also gave him a Royal Mail Special Delivery tracking number so he could track the return of the passports.

All the requested documents were emailed to...

One reads about these things but never truly realise the implications, not being able to fulfill...

But you're right, I've read some horror stories about AP with the person not even knowing WHY it's happening! And can't help think what if it turns into that...
