Re: Entering the US with AP but still with valid L status- what's the deal

There seems to be some confusion about STATUS versus EMPLOYMENT AUTHORIZATION in this thread.

If the OP returns using AP, they will be a Parolee, which will be evidenced by the I-94 issued.

Re: Question re. I485 for family

meauxna,

I know you didn't want an answer.

It isn't "common" practice for this to happen.

Where I have seen it happen mostly, is where the primary was able to file concurrently in July 2007...

Re: Question re. I485 for family

I am not sure I agree with the answer on this occasion.

It seems you are thinking that the OP would have to sponsor under F2A, which isn't the case, since they are already married.

He can...

Re: First Time Completing Tax Return - SSN question

That's exactly how it worked for us as well.

I needed an ITIN, so I had to fill in a Form W-7 and attach the tax return to that.

The tax return was sent to the ITIN address rather than the one...

Re: Visa bulletin???

The explanation is also given in the January Visa Bulletin (http://travel.state.gov/visa/bulletin/bulletin_5212.html).

So many people have now applied, that the dates have had to go backwards...

Re: Going from O1 to EB1 in the arts

Although not articulated in the INA as H and L visas are, O visas are dual intent under 8CFR.

The relevant section is 8CFR 214.2(o)(13) :

Nor is it necessary for an O visa holder to...

Re: Entering under an R1 Visa

It removes that hurdle - yes.

I still don't see your duties (as described) fitting an R-1 visa.

Re: EB1 questions

Your post is very confusing.

I have to assume you are Consular Processing the Visa application. I can't help with that since we AOS'd, but that is what the interview is for. Your I-140 will have...

Re: Entering under an R1 Visa

It doesn't sound like you would qualify under R-1 from what I could find. Quite apart from the nature of the work, you may not qualify for some of the other requirements, such as being a member of...

Re: Expat Tax Software

I've used ProTax Light for the last 5 years http://www.tax.co.uk/light/index.htm.

It costs ₤20 each year.

As penguinbar pointed out, you need to get your user details set up with HMRC.

It is...

Re: Employement based Green Card - payback terms

I think I too would caution signing anything that is based upon the I-485 approval date without knowing what category you would be in. That depends not only on your qualifications, but the...

Re: USA vs UK

That's not a fair comparison.

Geographically and politically, an "apples to apples" comparison would be between member states in the EU.

The EU member states correspond to the the States in the...

Re: Advice for a newbie

No.

O-3 is every bit as much the "Visa from Hell" as the H-4 is.

Because an LPR can only sponsor a limited class of family members under FB2 category.

Parents can only be sponsored by US Citizens.

Re: The Sausage Conundrum

My take on it.

If you take a sausage link and take the casing off, you have sausage meat, but not a sausage.

If you flatten it out into a disc shape you have merely created a sausage meat...

Re: H1-B Question

I don't believe an H1B transfer would be possible for a number of reasons. You wouldn't have the recent pay stubs required and the employer should have revoked the H1B when you terminated your...

You can find the regulations pertaining to AVR here (http://travel.state.gov/visa/laws/telegrams/telegrams_1441.html).

AVR can only be used if the visit has been solely to Canada:

I can't see any particular advantages of using Canada, if he is travelling to Pakistan anyway.

Since he would be going for a visa appointment, he would be ineligible to use Automatic Visa...

It is hardly the simple theft of of a computer is it?

That was my thought process as well. It was also why I deliberately used the word "might". It is not a very precise definition and lends itself to different interpretations.

It needs checking with...

Re: L1, H1B, working spouse questions

I certainly wouldn't rely on ANYONE in HR for an opinion on immigration matters! YMMV.

The top 5% comment might be more appropriate to EB1A and EB1B, but EB1C only needs to meet the criteria laid...

Re: L1, H1B, working spouse questions

It might well be. The regulations only appear to require one year within the previous three, not that you are working with the company prior to admission. For the sake of completeness 101(a)(15)(L)...

Re: Company approves Green Card process

From the information you provide, it is difficult to see how it can be assessed as EB2.

The problem is that, to be classified as EB2 using the normal "Advanced Degree" route, the job must require...
