my wife got her citizenship through ministerial discretion. we have been living in the U.S. for sometime. I think it boils down to WHY you are overseas + how long you have already spent in Australia....

We applied for citizenship for my wife at the OCU (overseas citizenship unit) back in November 2012. No progress yet. Apparently they moved their processing unit from Melbourne to Canberra earlier...

I agree with DIAC's assessment. If you had no valid visa & you were outside Australia at that time, where does the concept of "residency" apply?

That means anyone who has obtained a tourist visa...

If I remember correctly, I was in a similar situation almost 10 years back. In fact ACS assessment came back as "unsuitable for migration". Then I asked George to be my agent. Now I am a citizen :-) ...

That is really sad my friend. You should have used an agent. They would have seen other people with similar background and would have known how to properly present your case in a way that might have...

I have been in the U.S. for about 5 months now. I became a citizen early this year.

My wife was only 4 days away from satisfying the residency requirements in her own...

You are allowed a total of 1 year out of the 4 to be out of the country.

So if you haven't been out of the country for a total of 365 days, then this 1 week in hong kong is within the 365 day...

If your spouse is an australian citizen (and you are living with your spouse), my understanding is that time spent with the spouse will be counted as time spent in Australia.

i think it is done for spouse applicants. For spouses there is an exception that they can stay overseas but still they can become a citizen after the "residency time" has passed. time spent overseas...
