1) Yes---The Appeal Court and the Supreme Court hear Appeals and give a judgement. They do not "Act" when they get the urge! Both Courts heard an appeal in the case you described.

Different visa requirements are not the same as FOM. As I said above Mrs May made visa changes following her visit to India 6 months after the 2016 referendum.
