It depends where he is in the Visa process, has he filled for AOS yet? How long has he been in America? How long has he been married? Can he prove that she is cheating?

I was in the same situation as you.....

You HAVE to get your child UK & USA passports, you can no longer add a child to your passports. If the child is a USC by birth, you must get a born abroad...

As your student visa expires very soon, it doesn't matter whether you apply on the K1 (fiancee) or K3 (spouse), as you will most probably have to return to your country of origin before.
