Re: E-3 Visa for Australians Thread- It's all in here

This is one area where the E-3 is different to the H-1B. There can only be one outstanding E-3, so when a new one is issued the old one is automatically cancelled. That has always been an issue for...

Re: E-3 Visa for Australians Thread- It's all in here

There is, however, this warning on the Canadian consulate sites relating to the E-3. Anecdotal evidence also suggests that new E-3's are becoming harder to obtain, greater scrutiny of the labor...

Re: E-3 Visa for Australians Thread- It's all in here

They are much stricter now. I have had two friends recently who both had their E-3s applications rejected on the basis that there was insufficient nexus between their degree and their LCA. Unless...

Re: E-3 Visa for Australians Thread- It's all in here

Bahamas won't process visas unless you are a Bahamian resident and Canada has about a six week wait for appointments.

Re: E-3 Visa for Australians Thread- It's all in here

It appears that Nassau is back to processing e-3s which is handy. They still have collection for non-residents which is the best part about Nassau.

If you are worried about first-time processing...

Re: E-3 Visa for Australians Thread- It's all in here

You have to extend your LCA and your visa to be able to keep working in the USA.

Why don't you just go for an Adjustment of Status.

Re: E-3 Visa for Australians Thread- It's all in here

CBP will let you in on the basis of the E-3 but you will be in breach of the visa conditions if you enter and don't start work within 10 days. You may also be forced in to lying to a CBP officer if...

Re: E-3 Visa for Australians Thread- It's all in here

The issue is that your company can only pay you by cheque and will have to withhold at the full rate. You should have HR speak to payroll. They can have you start working without the SSN, it just...

Re: E-3 Visa for Australians Thread- It's all in here

It's a well known rule that in country extension is useless if you travel outside of the US. You need to get a valid E-3 Visa to re-enter or if you still have a still valid visa that is what you are...

Re: E-3 Visa for Australians Thread- It's all in here

This is part of the privilege of being able to work in the United States. Everyone who comes here to work whether it be on the E-3 or otherwise makes sacrifices. You have to decide what's more...

Re: E-3 Visa for Australians Thread- It's all in here

It's an Embassy and not a consulate.

They have a history of approving the E-3 but your circumstances may not be the same as others. I would also note that I have heard some instances where the...

Re: E-3 Visa for Australians Thread- It's all in here

You should have got a new I-94 with a March 2013 expiry date with your in country E-3 extension. There should be a piece of paper with a tear out I-94.

Re: E-3 Visa for Australians Thread- It's all in here

If you're going to bring your resume, E-3 application materials and no return ticket to Australia you may be stopped at POE on the VWP. You won't even get the chance to interview.

Re: E-3 Visa for Australians Thread- It's all in here

Actually, when the change application goes through the status remains as J-1 until the J-1 status runs out. J-1 (depending on which one) may allow the type of work that is being contemplated.

Re: E-3 Visa for Australians Thread- It's all in here

Just a word of warning on going down the I-539 route is that once you change your status if you ever leave the country for any reason you will need to go through the whole process of applying for the...

Re: E-3 Visa for Australians Thread- It's all in here

This is going to be the difficult part. Canadian consulate interviews are open six weeks prior to the proposed interview date and even then it's pretty hard to get an interview.
