Hmm, shouldn't be an issue. H1B is valid for quite some time, I-130 should be adjudicated well in advance. Of most concern is the visa application and subsequent interview for the H1B when a K3...

I am a US citizen, my spouse is a UK citizen. I applied for a K3 visa for her and while we've been waiting for the final approval, an H1B petition filed for her long ago was finally approved.
