Re: E3 visa

The 'dual intent' issue with E3 hasn't been resolved by the USCIS in my attorneys opinion. Maybe the US is willing to cut Australians a break for the moment. I took a slight risk and was successful...

Re: E3 visa

They mail the GC to you here in the US if you choose the 485 aka adjustment of status route. It arrived a week after the approval email. There is a different green card path called consular...

Re: E3 visa

I adjusted status in the US. Going to a consulate is a crazy idea IMO - waste of money for flights, long lines at the consulate and a nerve-racking interview.

Re: E3 visa

For those interested in the green card. I filed for my first E3 in July 2005, and a second concurrent E3 was filed and approved in August 2006. I filed for a green card in June 2006 and it was...

Re: E3 visa

The DOL website creates a PDF immediately after you submit the LCA form on the website. There is no waiting for approval. Perhaps the employer did it wrong.

Re: E3 visa

Absolutely not. Look at the LCA filing link on http://www.lca.doleta.gov. It clearly indicates the LCA must be filed by the employer. If you fill it in, it's probably fraud.

Re: E3 visa

This is incorrect. The employer must apply for the LCA, not the employee. They can do this online very quickly as it is approved automatically. Then they print it out, sign it and give you a hardcopy...

Re: Bachelor Degree - Academic Credential

Don't panic. You shouldn't need to get an evaluation to show a three year Aus degree is OK. It seems the USCIS is mainly biased against the Indian three year degrees.

Just file your E3...

Re: Self employment

I would consult an attorney before trying it. I'd be very reluctant to walk into a consulate or USCIS with a job offer that I had signed myself. It's an immediate red flag, because very few visas...

Re: Application Fees & Spouse/children requirements

The USCIS site says at http://www.uscis.gov/graphics/publicaffairs/newsrels/E3_010606PR.pdf

Evidence that the alien meets the educational requirements for the position to be filled (a bachelor’s...

Re: Application Fees & Spouse/children requirements

Sorry to be the bearer of bad news, but you must have a bachelors degree or higher for an E3. I'm not sure how you could get an H1B without one either?

Re: Financial Stability

The Immigration and Nationality Act requires the sponsor to be legitimate. They could ask - does this company have the ability to pay the wage offered?. The USCIS don't usually ask this - but there...

Re: E3 visa

If you can file for your E3 visa with the USCIS without leaving the US, I would do that. There are many downsides to going to a Canadian or Mexican consulate to get the visa.

1) Long waits to get...

Re: Work authorization for E-3 spouse? How long does it take?

The E3 is for 2 years - just put 2. You may renew the E3 as long as you like, but only in 2 year increments or less.

I don't think you need to leave the country. Just get the LCA approved and...

Re: Banking Jobs & H1B/E3 Visa Sponsorers

Neil

You should have no problem at all getting an E3 visa to work in that job and industry. Having an MBA shows it is clearly a professional position. The head of the World Bank was until recently...

Re: E3 visa Approved

Always tell the truth. Don't offer any info they don't ask for. In general, keep your mouth shut until they ask you something, and give direct, short, truthful answers. Be prepared to talk about what...

Re: E3 LCA wait time

Can you use a faxed LCA or not for the E3? Colin posted earlier that his consulate would not accept it. Another poster said his was accepted. Does anyone know the official answer?

Re: E3 visa Approved

Unfortunately, you have to leave immediately if you lose the job. There is no grace period. It sucks, because if you do stay and you are 'out of status' then you can be barred from the US for years....

Re: E3-d

A lot of H1 visa holders file a part-time visa concurrently to their fulltime. E.g. let's say you find a consulting gig for one day a month with a friendly company. It may even be a company where you...

Re: Tax in US

Colin,

Congrats on getting your E3.

Australian citizens living all year in the US pay US taxes - not Australian taxes? It's US citizens that pay taxes on worldwide income, not Australians.

I...

Re: Tax in US

I don't mean to be negative, but $75k plus benefits in the Bay Area is nothing. The cost of living in San Francisco and surrounds is astronomical. You would be better off financially staying in...

Re: E3 visa Approved

Check the state DMV website. As I understand it, you can usually drive on a regular Aussie license for 30 days or so. Once you intend to become a resident you only have a short time to get a license...
