I had a similar issue a few months ago when I applied for renewal. I put my first name as both names, and the consular officer changed it manually, was not a big deal.

Once you leave the U.S. the status is gone, so the fact your wife never changed status should not affect her getting the visa. The only minor issue is that once you are not H1B, her H4 is void, so...

As for 'proof of ties' it can be to any country out of the U.S., just show ties to the EU country you've been in...

Well, since you are already in good contact with Sydney, maybe send them the correct link on the USCIS official guidance from over a year ago on the E-3 including how to transfer (=I-129 to vermont)...

It is interesting, though only preliminary and I know for a fact that the data is inccurate. Their figure is a bit lower that the acctual E-3's issued, but we're still far away from the 10500 cap.

Well, the answer is yes I had all the original documents. I can't remember if they asked to see any of them, except for the original LCA that was definately required.

It was a full new E3 visa with full supporting documnets.
I went back to the same consulate that issued the 1st and met the same officers I met the 1st time. It was a very smooth interview.

I got the EAD for my spouse a year ago, by marking the (a)(17) for E1/E2 and wrote in the remarks E-3 for Australians - it worked with no problems.

In general, one may not remain in the US after any visa expires and wait for a discission on visa change of status. However, this would most probably only be a problem if the request is rejected....

If one go's out of country to apply a new E-3 visa, and they got rejected, if she/he can still work for "A" after he/she return, I think would depend on why they were rejected.

Once you leave the country, you lose your status, so there is nothing to adjust. If you are granted the E-3 in Oz, you don't reallly care about the I-129 anymore which would be void anyway be cause...

No it wouldn't be legal, having the SSN does not allow anything. It will just save you a step.
However, it would probably be quicker to get a new E-3. If you get an offer fly to a consulate that has...

Transfer is the same, but they may suspect that you never intended to work for "A" and acuse you with Fraud. It would be better to request a new visa for "B", then everything is straight forward.

No problem on the consulates side to issue you a new E-3 if you decided to go with another employer. It would be the correct course of action rather than changing after you enter.

The 221(g) is not a closed list.
It just meens the consulate needs more info on the applicant or the company.
The denial is more like a delay and if all the list is supplied they will issue a visa.
