No. As long as you are eligible to apply for the E-3, the previous H-1B should not matter.



I believe the requirement is to demonstrate that you will leave the US when the visa expires....

It may be the "easiest course to take", but Canada is not obligated to process your E3. They might... but they don't have to - especially if you have no status in Canada other than "visitor". Good...

You still haven't! You said you "moved to Company B, who lodged I-129..." The question remains, did you start to work for Company B *before* the I-129 was approved?

You mean Company B filed an I-129, and it was approved, and then you went to work for them... right? If it didn't happen in this order, you are likely out of status.

If you are married to a US citizen and have applied to adjust your status (form I-485), yes... you are allowed to remain in the US until such time as the application is adjudicated.

If you have applied for Adjustment of Status based on marriage to a US citizen, you don't have to leave the US, even if you lose your E3 job. Your AoS is still valid even if the job disappears.

The assumption here is that wherever "across the border" is, they participate in the visa waiver program. Neither Canada nor Mexico participate in the VWP... for a reason!

I think you are not right. The D/S notation stands for "duration of status". This means that as long as your visa is valid, you can remain in the US. That you have an EAD that expires in December...

The concept of "dual intent" is often misunderstood... as you have misunderstood. Just because a visa/status does not specifically allow dual intent, that's not the same as dual intent being...

:) An AOS *is* the whole PR app! AOS = Adjustment of Status from whatever you currently are, to Permanent Resident.

You'll need an I-130, I-485, I-131, I-864, I-765, G-325a... and all the support...

That may be an employer-based policy, but by law you *are* allowed to work as long as you can demonstrate that you have applied for a SSN.

Yes... unless you manage to get a job offer from a cap-exempt company such as a university or not-for-profit business - but that's pretty rare.

The next H-1B season opens on April 1, 2009 for work starting October 2009. Good luck... it is heavily oversubscribed and really is a lottery these days.

I'm pretty sure that becoming a US permanent resident has nothing whatsoever to do with your current citizenship(s). There are limited routes to PR status... and, as a CDN citizen, I can assure you...
