These are all questions that the lawyer would answer. No need for you to worry about the visa type. As a new employee I doubt you have enough insight into the structure and and scope of the business...

That's not how it works. The employer must file the petition for the visa, not the employee. I don't know why you feel the need to do unpaid research for them that their HR department and immigration...
