Re: British citizen living abroad? Non-EEA spouse? This may affect you!

Not sure it's a 'glaring' problem... but it's important to be aware that some married couples have experienced trouble when a non-EEA spouse accompanies the British partner to the UK for a long...

Re: British citizen living abroad? Non-EEA spouse? This may affect you!

These are the old rules, correct up until 9 July 2012. Is this 'advice' really still being posted on immigrationboards.com as valid for today?

Maybe it's an old stickie info post that the Mods...

Re: British citizen living abroad? Non-EEA spouse? This may affect you!

HVicky, he should check up on Italian citizenship laws ASAP. If he can get EU citizenship, he can move to the UK without the need for a UK spouse visa. :fingerscrossed:

Re: British citizen living abroad? Non-EEA spouse? This may affect you!

Hi Mymorg and Tickletori, it might be better if both of you post new, separate threads on this board (below), with a title that outlines what you think is your proposed route to the UK.

This...

Re: British citizen living abroad? Non-EEA spouse? This may affect you!

Well done, WolfieThai! That is a LOT of reading, but IMO it is indeed one of the best ways to understand the ins & outs of the new spouse visa requirements.

Yes, this is the nice thing. ...

Re: British citizen living abroad? Non-EEA spouse? This may affect you!

In the news yesterday, the case of a newly-wed British woman whose non-EEA husband's spouse visa application was denied. He's been told to go back to his home country just as their baby is due to be...

Re: British citizen living abroad? Non-EEA spouse? This may affect you!

Exactly, they want to cut those non-EEA numbers any way they can!

The only way to defeat their aim is to do as much research as possible to ferret out all the angles for every single possibility...

Re: Theresa May wants minimum income of £25,700; £49,000 if you have 2 kids

:goodpost: Brilliant post!!! Thank you for this clear explanation, Rebeccajo!

I'd forgotten all about the Statement of Intent, which is in in many ways MUCH easier to...

Re: British citizen living abroad? Non-EEA spouse? This may affect you!

You'll figure out the quote system--don't worry.

Blackpudlian, I think your best bet right now is to breathe in & out. Saurus is right that you may have the resources to do this, but it may take...

Re: British citizen living abroad? Non-EEA spouse? This may affect you!

Yes, absolutely. As Sarus has said, 4 years used to be a magic number for an easier path to permanent residency for the foreign spouse, but now any couple married any length of time (newlyweds too)...

Re: British citizen living abroad? Non-EEA spouse? This may affect you!

If this is a true story, the Englishman's first mistake would probably be saying that his (and his non-EEA wife's) settlement in Ireland was not "permanent". Exercizing EEA/EU treaty rights implies...

Re: British citizen living abroad? Non-EEA spouse? This may affect you!

Holly, I'm not sure I understand your response.... Are you saying that the non-EEA spouse should not enter Ireland WITH the UK/EU citizen, but separately?

And as to your second point, what if the...

Re: British citizen living abroad? Non-EEA spouse? This may affect you!

Yes, all the EEA/EU residence permits & cards are free. I think it's the EEA/EU Family Permit that your wife may need before you both move to the UK (after living & working in ROI for the certain...

Re: British citizen living abroad? Non-EEA spouse? This may affect you!

I'm no expert, but my understanding is that as the UK/EU citizen you are allowed to simply move to Republic Of Ireland any time you want and start working. And the same is true of your UK/EU...

Re: British citizen living abroad? Non-EEA spouse? This may affect you!

Yes, this confusion has come up time after time. I wish UKBA would edit the directions on this particular page. That first line should read: spouse or civil partner of someone settled (or with the...

Re: British citizen living abroad? Non-EEA spouse? This may affect you!

Very true! The more important key seems to be the exercising/working in the (non-UK) EU/EEA country, so I assume that factor trumps the intent (that of eventually bringing the spouse to the UK).

Re: British citizen living abroad? Non-EEA spouse? This may affect you!

Yes, the McCarthy ruling seems to have closed the door on the "hidden benefit" of a dual UK/EU citizen, that of being able to bring a non-EEA/EU spouse into the UK under EU rules. McCarthy had never...

Re: British citizen living abroad? Non-EEA spouse? This may affect you!

Where did you get this figure of 6 and 1/2 years to UK citizenship under the EU (Singh) route? The UK partner exercises treaty rights in the second EU country for perhaps 6 months while living with...

Re: British citizen living abroad? Non-EEA spouse? This may affect you!

Such sensible words from the journalist who wrote the article (but who is uncredited):

This is what makes me so angry about this law. It unfairly targets the young couples (and many older ones...

Re: British citizen living abroad? Non-EEA spouse? This may affect you!

So are these two statements contradictory or not? Does Alliekat or any other non-EEA spouse coming in under Singh need to be employed in order to access free UK NHS or not?

I've been...
