First of all, if you got married while she was here you can't file for a fiance visa - she's not your fiance, she's your wife and you would need to file for a spousal visa.

First of all, if you got married while she was here you can't file for a fiance visa - she's not your fiance, she's your wife and you would need to file for a spousal visa.

The I601 waiver is required if you have a crime of moral turpitude on your criminal history. You can only apply for the waiver AFTER your visa is denied.
A DUI is very definitely a criminal...
