I will be over my visa by more than 180 days in early Feb. At what point in the application process does the 3 year ban no longer apply?

1) the date we mail in the visa petition?

Yes, he's a lovely, special, wonderful USC. :p And yep, a little scared but not scared enough to not try. I don't plan to leave on my own accord now until we have an outcome one way or the other.
