I read somewhere that it helps if you can prove you're going to stay in the UK. I entered on VWP Aug 07, left June 08, 10 months stay so minus either 90 or 180 days, that's the overstay. less than...

so just to be technical for aminute, how can I be in deportation proceedings when I'm not even in the USA?
And, fyi i wouldn't attempt to go back until the (wrongful) deportation was removed....

I did file within 90 days. I had a green card interview date for 5 days after I left the country. I sent a letter withdrawing with a copy of my one way ticket....at the moment, the ISCIS is claiming...

thanks for all the posts. Basically, yes we were (wrongly)advised that I could change status once in the US on a VWP! the attorney we are using had never done this before she seems to do straight...

When I moved with my American OH they only ran a credit check on me, I'd kept credit cards, bank accounts in the Uk so that worked.

do you mean the chances of getting the B2 would be slim? Why?

my accountant said don't do anything....I"m not saying he's an expert on emmigration, but in terms of taxes, he's like you're filed and you'll keep filing so what's the problem....
