The forms themselves don't ask about his US status as such.

It does state however that non US residents should apply in their own country. Applying in the US would have made things a zillion times...

But surely because he's overstaying his visa he won't be allowed to apply in the US, because he's not even supposed to be there??:confused:

Thanks for all your advice.

We plan on returning to his own country ( Domnican republic) to apply for the visa. We've been told this is the only way to do it?:confused:
