Re: Estimate

Why not have the same requirement for the mother then. Example, mom has kid, abandons family. Father raises kid. Mom can apply for permanent resident.

Had Dad done the same thing, he wouldn't...

Re: Estimate

OK, but why do they ask for a birth certificate showing that the mother and father were married before the birth? Because they later talk about requiring more evidence of the father/child...

Re: Estimate

Would be from Peru (just interested in a rough estimate for planning). Also a question about the I-130. Why do they ask for the father's marriage certificate in addition to the child's birth...

Mother in Law Adjustment of Status

My MIL is visiting us because we should be having a baby within the next few days. She originally was just going to stay a couple months, but might stay for a longer period now.

She definitlely...

Entered U.S. illegally, married U.S Citizen

What are the options for someone who entered the country illegally (used papers of another) and has married a U.S. citizen. Is there any way to apply for permanent residence without leaving the...

Re: Adjust Status or I-131

Damned if I do, damned if I don't :)

Well, she's been here several times without a problem. Do you think it is really a risk? More than a 10% chance she will be denied entry if we begin the...

Re: Adjust Status or I-131

OK, assuming I have discarded the idea of adjusting her status here. It seems like it will be much more expensive than it would be worth.

Would my MIL have to surrender her tourist visa while her...

Re: Adjust Status or I-131

Well, let's put it this way. Either way she is going to come to the U.S. She will be here either as a tourist "briefly" before she adjusts her status, or for a more lengthy period as she waits for...

Re: Adjust Status or I-131

She also has the option of adjusting her status while in the U.S. (much like a fiancee) which is why I ask the question.

Re: Adjust Status or I-131

By the way, I meant I-130. I guess my thought with the intent to stay is BCIS probably doesn't really care because either way she easily qualifies for a green card. Even if she applies abroad she...
