Re: Facing deportation

Hi meauxna,

I'm curious what the terminology is in her case -- her status has been "adjusted", but now is "out of status" - so I guess the correct terminology is to get her back on "in status" or...

Re: Facing deportation

That's just superb. So looks like as long as we continue to take actions to sort things out, there are some silver lining ahead. Even if our I-751 gets denied, restart the AOS application and receive...

Re: Facing deportation

Hi Elvira,

Thank you -- I'll consult with the CPA tomorrow to see if it's possible to file with her TIN the years BEFORE it expired.

Government bureaucracy is something everyone resents, but...

Re: Facing deportation

Thanks very much Ian, I truly hope that's the case. There are cases that I've read where a couple of weeks, even a month late was okay, and without much of an explanation (not certainly illness or...

Re: Facing deportation

My mistake on that Rete - I keep using "us" when I should say "I". She indeed has not worked from the day she arrived here til now. I have been able to provide for both of us, although in hindsight...

Re: Facing deportation

Hi everyone,

Thanks again for all of the thoughtful replies. A few notes..

Re: Facing deportation

Absolutely right Elvira. We went though every box and found as much evidence as we can, and sent out emails and called colleagues, ex-bosses, etc. for affidavits. We have our I-751 filled, but we'll...

Re: Facing deportation

I completely agree - she has to take the big first step sometime. Thank you so much for your thoughts and advise.

We just hope that the removal process has not begun, and even if it has, we can...

Re: Facing deportation

Can't argue there Elvira.

We were looking ahead, as she is slowly getting over her issues and even passed her tests to enter an art school in NYC. Having said that, the language issue has been a...

Re: Facing deportation

This I have to take full responsibilities for -- she still doesn't speak English very well and have trusted me to get the process forward. I had the dumbest notion that somehow we'd be notified for...

Re: Facing deportation

Will do -- obviously being the first time being in this situation, not sure how much of the "get the best representation money can buy" holds true here.

I will also look for the school / years of...

Thanks so much Elvira -- I've placed a few calls in the Manhattan area.

Re: Facing deportation

Whew -- the last thing we want to do is for her to be out of the country and can't return.

Glad to know that she can adjust her status while being in US, given legal and other help!

We can...

Re: Facing deportation

Thanks very much David,

Is it actually possible to start from scratch? If so, I would assume that she has to leave the country, and if so, would that mean a certain # years ban on re-entering US?

Re: Facing deportation

Thanks Rene -- is there anyway helpful guide or list of experienced lawyer, or is it getting a list locally (we live in Manhattan) and calling and asking questions regarding our case?

Facing deportation

Hi,

I was referred here by visajourney.com, and though I would post our dire situation here and ask for help also.

I wished that I was even remotely responsible many months ago. My wife and I...
