We did receive a receipt and a one year extension but that has now expired.that is what triggered me into calling the 800 number.

Are you sure that their marriage is a sham? Why don't you focus on your own affairs? If their marriage is a sham, then INS will find out. Do not make assumptions based on your own beliefs.
