I'm not quite sure, but I think it depends on how many days without a status (ilegaly) he was in the US. If it's less than 180 days then it's a 3 year ban, if it's more than that and even over a year...

There's no right to appeal on the denial, but you can always reapply if the denial was because of technical reasons, like failing to submit all the evidence requested.

I had to re-apply for AOS too and I used the same A# that I had from the previous case.
