She never was an Estonian citizen; just a resident. Hence the "alien passport" - it was issued to allow residents to travel but was different to the one a citizen would get, from what I can gather. ...

So deliberately representing oneself at the POE as having no immigrant intent when you do for the purpose of obtaining entry to the US would be covered by that, but that's where the burden of proof...

Entering on a nonimmigrant visa with preconceived intent to immigrate is deemed as visa fraud, correct? Or perhaps "material misrepresentation" is the correct term - I'm not a lawyer ;)

It turns out that my friend misunderstood the "90 days" thing and did, in fact, marry within the K1 boundary. That's a big relief, as she can still AOS from the original I-129F.

I don't regret doing AOS from the VWP, but for my own peace of mind I'm not sure I'd do it again. The panic about it all going FUBAR was quite overwhelming at times.

Granted, he also speaks English fluently, which muddies the waters somewhat.

I am aware that C1 isn't just for crew people, I just hadn't really considered the implications of this case - beings that it's not me!

They won't get married on B2 or VWP, so that's not an issue....
