Any way around it...? what if I had an O-1 visa stamp in my passport (even thought I've applied for change of status)?

I married my American sweetheart in New York City. I filed the forms, i-130, i-131, i-864, i-765, etc. etc. all together on the 4th September. I requested Advance Parole, which I'm told takes 90 days...

...just a plain old tourist visa waiver. Now I understand I have to attach the K1 with my AOS forms. Is this a problem?
