Yes that’ll be the EB-5, which is an immigrant visa. The E-2 treaty investor visa, on the other hand, is a nonimmigrant visa that generally requires a somewhat lower investment amount. <snip>

A foreign residence isn't required to demonstrate eligibility for E-2 status. You will, however, need to sign a letter expressing your intent to depart the U.S. upon expiration of your E status.
