Re: Unemployment on Green Card

I would not be concerned for the reasons others have mentioned. California’s program is also funded by employee/employer contributions, so it’s not a welfare program. I’m sure you would have been be...

Re: Estate and Inheritance Tax

Since 2019, yes. With UK ETA rolling out in the next year or two, an ETA will be an additional requirement if using a non-UK passport I guess. It will be interesting to see if the UK will require a...

Re: Estate and Inheritance Tax

Interesting about the consular assistance. I would not expect that to be the case as long as citizenship is held, but I do believe which passport is used to enter a country when holding multiple...

Re: Estate and Inheritance Tax

So Mr. Pulaski, based on all the discussion here, are you convinced it’s not necessary to give up your pension or citizenship? I’d say they are both serious considerations not to be taken lightly....

Re: Estate and Inheritance Tax

Those are fair points. I have no issue with being informed or corrected beyond what information I’ve found online. There is certainly some conflated information out there concerning the non-dom...

Looks like the first link got combined with the second…should be fixed here. This is obviously an often cited case that involves a much...

Re: Estate and Inheritance Tax

Here’s some good primer articles on domicile for anyone interested. I have some articles related to changes to domicile between states that I’ll try and post later.

Re: N400 - Failure to register with selective service

Up until the age of 26 he can still register without issue, but the option to register upon turning 26 is lost forever. Technically, he should have registered when turning age 18 or when he got his...

Re: Estate and Inheritance Tax

GG, I have to disagree with you on some points:

A domicile of choice is dependent upon two things. First establishing residency in a country with a distinctive a legal system; second the intention...

Re: Estate and Inheritance Tax

I touched on this in my other posts, but unless I misunderstood your post, if you die first, your spouse will be impacted because she doesn’t have a UK domicile of origin (unless she elects to be UK...

Re: Estate and Inheritance Tax

You’ll want to get some professional tax advice before setting up a trust. Trusts are treated very differently by the UK and US, and you could trigger an immediate UK tax liability depending on your...

Re: Estate and Inheritance Tax

It’s also important to note that even without being deemed domiciled, it’s still possible (and almost all expats will be) considered domiciled in the UK under UK common law because it is extremely...

Re: Estate and Inheritance Tax

Drawing the UK state pension is another tie to the UK. I probably could have made voluntary NI contributions but never intend to or apply for the pension for this reason, regardless of the return on...

Re: Estate and Inheritance Tax

It’s virtually impossible to determine if one has obtained a domicile of choice, because HMRC won’t issue an opinion anymore. It can only be determined after death, leaving it to one’s heirs to...

Re: Estate and Inheritance Tax

Good points. I would add the a UK domicile of origin is acquired via one’s father if he had a UK domicile of origin, or one’s mother if one’s parents were not married when the person in question was...

Re: N400 - Failure to register with selective service

This is a good point I’d forgotten about, but as you suggested (“very likely”) it’s not a certainty USCIS actually did register him. The OP should check he isn’t already registered if hasn’t done so...

Re: N400 - Failure to register with selective service

How long do you have until you’re 31? My opinion is to wait until 31, which will be less than 5 years in your case. While you can show it wasn’t willful, it’s discretionary and thus a gamble, plus...

Re: N400 Application concerns, please advise.

On point #3, I don’t see you should have any concern. All that matters is there was no fraud or collusion in obtaining your green card, and at the time you were admitted to the US as a PR, your...

Re: Where do I enter UK state pension on 1040

As others have noted in other threads it can sometimes be beneficial to report federally under “Pension Income” if your state does not tax pensions. Otherwise, it probably doesn’t matter.

Re: When can I apply for citizenship?

Interesting. It seems likely one of the motivations for this policy is the preferential tax treatment (unlimited spousal estate asset transfers) since the risk of a military spouse dying in service...

Re: When can I apply for citizenship?

Other than being able to vote and the other benefits (and responsibilities) of citizenship, the most significant benefit to me is the permanency that comes with citizenship, and not having the risk...

Re: When can I apply for citizenship?

Agreed. I was just saying my situation was the 3/yr and 5/yr rule coincided about the same time. In the big picture the two year difference probably doesn’t matter that much for most people. If I...
