Re: Immigration with a child

Hi yes unfortunately he would not give permission if I located him. He's not the obliging type. But thank you for your suggestion all the same.

Re: Do I need a CNI certificate to marry in the US?

Thank you so much for taking the time to answer! Yes from what I read Washington State doesn't require it. Strange how the wording appears to make it sound mandatory on our government website....

Re: Do I need a CNI certificate to marry in the US?

Yeah I'm a Brit, apparently a CNI is needed when marrying abroad but what I can't find out is if the state I'm marrying in requires it? I was just going to marry on a ESTA and come home but maybe...

Re: Do I need a CNI certificate to marry in the US?

Thank you so much! I will ask him to check. I can't see anything online for Washington State requiring it but I thought I'd check!

Do I need a CNI certificate to marry in the US?

I'm a UK citizen hoping to marry my fiance in Washington State. Apparently UK citizens need to get a CNI to provide to the government where we plan to marry but I don't know if Washington State even...

Re: Immigration with a child

Yes I would have thought they would and his mother will still be there no doubt, she'll open his mail too.

Re: Immigration with a child

If they attempt to find him at one of his last known addresses, she probably still resides there and once she knows what I want to do she will do all she can to stop me but the courts would no doubt...

Re: Immigration with a child

I shall be getting some legal advice on this, just hate that it will cost me thousands when I need to save towards moving to the states ☹

Re: Immigration with a child

That's what I wondered but I guess we would have to be seen to be trying to find him. Maybe whoever works for the courts would locate him on my behalf? Not too sure.

Re: Immigration with a child

Very interesting! In my case I have another factor and that is his mother. He had a slow mental decline just before, during and after the birth of our daughter which led to him being sectioned under...

Re: Immigration with a child

Very true and I think even at her age now what she would want would carry weight. Ultimately the courts are supposed to prioritise the child's welfare and her being with me abroad would certainly be...

Re: Immigration with a child

I have just read that from the age of 16 my daughter can legally come with me according to UK law. If I don't go through the costly process of court I may have to wait another 5 years I guess!

Re: Immigration with a child

Thank you for the information. Yes we wouldn't do the K1 Visa as I don't plan to move there as soon as we marry. I plan to marry him on a ESTA visa then come home and gradually sort everything.

Re: Immigration with a child

Indeed this is all going to take time! When I visit next time I'll look into schools more thoroughly but for now I'll need to make sure I can legally take her. Yes if she is 16-18 and doesn't want to...

Re: Immigration with a child

Sorry I meant it looks like I wouldn't be able to just leave without sorting this element first so I couldn't be accused of child abduction after the fact. Sorry to confuse.

Re: Immigration with a child

Yeah I would try and sort the arrangement order within the next year or so to avoid it getting too close to the time I'd like to leave. Yes she will be about 14 if I am able to marry him this year or...

Re: Immigration with a child

Also I couldn't ever locate him and get his permission. He would stop me out of spite and make my life hell if he could. There's a history of violence so he wouldn't willingly oblige even if my...

Re: Immigration with a child

Thanks for the info. Yeah I knew about the Hague Convention but wasn't sure if the only time the child could be deported would be if the other parent went to court after the child had been taken. It...

Re: Immigration with a child

Hey it would be a spousal visa for me. Can my husband-to-be petition for my daughter too? Or would I need to petition for her if my visa is approved? My daughter is 11 years old.

Re: Immigration with a child

Hi Noorah101 👋

Thank you for replying and moving my post. I've searched everywhere and it doesn't mention it when I look at the US Embassy website or the UCIS either. Single mothers must emigrate...
