It might happen obviously, i wont file the 90 days before but the date i return and let's see. As you said, i have been waiting already so three months more wont harm anyone.

so that means that DHS might not take into account the 90 days? That's what i am assuming...

Everything was perfectly sorted before arriving. The consulate was very helpful

it was the visa as you said, i wont the lottery so i had to wait for the 5 years. Thanks, i will calculate it.
