I dont think this was the situation as the second owner was going to use it in France for Business use but suffered heart problems, he did try to go back to the UK as he gave us a letter to that...

We are not positive that the original exporter of the vehicle has passed on but we found a picture of him several years ago and he looks pretty elderly. We did inform the DVLA of the situation.

Further to this the DVLA has sent me an email explaining that I need to bring back the vehicle to the UK, But dont I then fall foul of the law by not having Tax and MOT.

Yes we got a Bill of sale from B but the Tax office said it was not proof of ownership. However I will point out two additional things the lady at our small prefecture and the lady in the Tax office...

I think we may have a clue to this problem for the sake of not naming names there are three persons involved.
A Original owner
B Second owner
and us C
A exported this vehicle and changed his mind...

Out of interest when a vehicle is exported.where can this information be obtained in this case France of the details of said owner. Does anyone know if the log book has to be surrendered on export?

I have sent email to DVLA to confirm or deny the registration by the second owner. You know the part you send off when register a new owner of a vehicle.

It has UK plates and I once again today confirmed it had been exported according to DVLA. I could not find out if the DVLA keep or take back the original log book.
