Re: I-140 and I-485 pending for 6 months

Slightly off-topic, but what are the current processing times for a full EB-2?

I understand that there's 1. PERM, 2. I-140 and 3. I-485. That a new PERM can take about 6 months (unless you're...

Using VWP with H1B in passport

Any ideas on how this might work:

Person A has a stamped H1B, valid for 3 years.

Person A resigns from job, and departs from the USA prior to expiry of the 60 day grace period.

Shortly...

Re: Silly question but can we just do it and move?

I asked the question out of interest for how the Aunt and Uncle arrived - not trying to explore a route through familal sponsorship.

OP - what visa are the Aunt and Uncle on? Through...

Re: Silly question but can we just do it and move?

Why not as a student? There's no age requirement for an F1, as far as I'm aware?

You'd need $50k per year or so, each. But it's not a million.

Re: Rant - H1B/L1 is just corporate slavery, crap life

The first three items in your post aren't that offputting. For starters - your current employer was willing to spend time and money on an H1B employee with no guarantee that they'd win the lottery....

Is this true though? I keep seeing this statement all over the forum. So much so, that I posted my own thread asking the question:

Re: Changing employers on H1B

Thanks for that. How long did your transfer take? Did you tell the first employer that you were transferring? I wouldn't want them to find out, then fire me before the receipt re: change of H1 is...

Re: New F1 during OPT

It now says "issued"? Does this mean it is with the courier?

Re: Changing employers on H1B

Is this a formality? Or is there a real risk that the transfer to the new employer may be refused?

If yes, what might be the reasons for the risk? For example, if you were an Accountant and you...

Re: Changing employers on H1B

That's what I thought. But the quota wouldn't apply as you already made it through under the first application, right?

Changing employers on H1B

I saw this on Pulaski's "Moving to the USA" post:

You are tied to your employer and employment for the duration of the visa. This means no unpaid leave or sabbaticals (being on the 'bench' is a...

Re: New F1 during OPT

Hi Rete

I don't think the article that you quoted was incorrect. If you read further down the page:Getting an F-1 Visa Stamp During OPT/STEM If a student's F-1 visa has expired and the student...

Re: New F1 during OPT

Is it normal for your visa application status to say "Administrative Processing" an hour after you were given a verbal approval by the consulate official?

Re: New F1 during OPT

Conversation went as follows:

Officer: Hello. So you are applying for F1. Where will you be studying?

Me: I am actually on OPT.

Officer: Ok, What were you studying and where?

Me: [Answers]

Re: New F1 during OPT

Thank you. This accords to my understanding.

I was just wondering if anyone else had been through a consular interview where "home ties" were asked for. I own a home in London, with family in the...

Re: New F1 during OPT

You don't need a new F1 visa, if your existing F1 visa is still valid. Mine isn't. I tried to check in at Heathrow, and the airline wouldn't let me board.

Re: New F1 during OPT

THanks michael

What was your general experience with respect to students renewing their F1s? Was it generally a smooth process, and hints on what typical questions might be?

Thanks

Yes ive been in touch with the DSO and she has advised me to bring those documents.

I understand it is slightly riskier renewing whilst on OPT rather than still going to lectures,...

Re: New F1 during OPT

Sorry when I said “stamp” I mean the F1 page in my passport.

It has a date - and it expired 5 months ago. My F1 was only granted for 1 year.

My question is about renewing (but in...

Re: New F1 during OPT

Yes, that is the issue. However I do recall some fervent argument on the board that OPT is study, for all intents and purposes.

Whether the consulate official sees it that way, is another...
