Re: Starting the Process

Because I lived in America for 23 years and saw lives completely ruined from the lack of socialized medicine. Plus Canada is a good halfway point between the USA and the UK, culturally.

Arrow Starting the Process

Hello all,

A bit of background - I am American, my wife is British. We lived in Canada for a year together on the "working holiday" type visa, and we got married there in April 2013. A few months...

From where I'm sitting, I...

Re: Covering my bases

You can't apply for a UK residency from outside the country. You have to be within the country to apply for an EEA spousal visa. We could still return to Ireland and apply for permanent residency...

Re: Covering my bases

Thanks Ian - We just have to decide now if we want to shell out for the I-130, or if we want to wait on this appeal which we just paid for and see where that goes. There's always Ireland - but I...

Re: Covering my bases

Moving to a host country specifically for SS is not considered an abuse by the EU courts, actually. It has been made crystal clear by a myriad of freedom of information requests, training guidance...

Re: Lawyer - yes or no?

No, neither of them have convictions or anything. Her wife is originally from South Africa and is now an EU resident, I don't know if that might be considered a complication?

Anyway, thanks for...

Re: Lawyer - yes or no?

Pulaski - Both, I guess? We are considering the possibility of moving to the USA, and I coincidentally have a friend who posted about her lawyer fees just yesterday. As far as I know, her case is...

Question Lawyer - yes or no?

From your experiences, should you get a lawyer or is it feasible to do on your own?

A friend of mine hired a lawyer, paid $4000 to file the application, and now they are asking her for $1200 more...

Re: Covering my bases

Oh! And we never had a "first application." We moved to Ireland together, got my residency, and moved to the UK. I was in the UK as a visitor for a few months while we decided our next steps. This...

Re: Covering my bases

I can see why that is confusing if you don't understand how EU free movement works! :) It is very complicated and frustrating, that's for sure! Under EU free movement, if a UK citizen moves to...

Re: Covering my bases

If you'll read above, I had to submit my passport to apply for my UK residency, and it was recently refused and they retained my passport.

Ireland DOES have to recognize same sex marriages when...

Re: Covering my bases

Ireland and the UK are required by EU law to recognize same sex marriage, and it was not a factor in our decision - plenty of other same sex couples immigrate to the UK and Ireland, and in fact have...

Hi Bunny - sorry should have paid more attention to my wording, I was indeed referring to a joint co-sponsor. I know that I am the primary sponsor. Also - I'm a woman, not a man. :) We were hoping to...

Re: Covering my bases

Haha ian -

The irony isn't lost on us either! The USA are shits with borders as well, but it's bigger and has more opportunities.

If I were to file an I-130 now, though, I'd need a sponsor,...

Re: UK wife - possibly looking to immigrate to USA

Thank you for the quick replies!

I was not aware I could file an I-130. I've been told my MULTIPLE immigration lawyers that the CR-1 of DCF was the only option. I was previously informed that I...
