Ok but what about the following?

The instructions for the I-131 says A I-485 needs to be filed and is pending with CIS, so it means if somone is here on a k3 visa and does Not have the I-485 filed...

That was my question, which link in the FAQ can I find out about filing the I-485 when the spouse is here on the k3 visa. Most of those links refer to a k1 visa procedures.

No the I-130 is still pending and it make take 2 years for approval on it since Nebraska Service is so far behind!

But for now I can start the I-765 papers.

Cindy thanks so MUCH for the help.

So this is what I will do:

1. Do I-765 (EAD) for my wife here on the k3 visa
2. Get her SS Card.
3. DO I-485 for Adjusting Status.

Is that correct?
