We were married by a priest, with a certificate and it appears on the county clerks records, but then because of the divorce snafu the marriage wasn't valid, but then after the EX died, and before...

I would never dream of taking him without permission obviously.
I am merely taking steps for if it comes to that and if I end up with custody, which in the event of any divorce I will fight for.

My own status in the USA would be rectifiable from what I have been led to understand by remarrying and then doing an adjustment of status.
However as I said recent events have complicated things...

My situation is quite complex due to a series of unfortunate events.

I am a british citizen, born and raised there currently residing in the US.
My son was born in the US before 1 July 2006...
