Re: Exciting News about PERM / Labor Certification Applications

To follow myself up... an advance copy of PERM is now available at http://www.ilw.com/lawyers/immigdaily/ and it is intended to be printed in the Federal Register on Monday. It will come into effect...

Re: Exciting News about PERM / Labor Certification Applications

Yes, but those in the know have repeatedly said that the final version of PERM will be VERY different from the draft version that was published a long long time ago. Although this was a good...

Re: H-1B Situation: Input of Experts is highly Appreciated

I would say you're still F-1, although it's just possible others might disagree. And unless you're in the midst of applying for a Green Card, what you got was a Labor Condition Attestation, not a...

Re: H1 Quota Filled. Need Help

Here's what I would do:
(1) File for your H-1B immediately with a start date of 10/01/04. Use Premium Processing so that you get it in a couple of weeks.
(2) Take a leave of absence from your job...

Re: H1B without a Bachelors

It should be doable. Three years of industry experience generally substitutes for one year of college. You need a good immigration lawyer (on the other hand, Bill Gates can probably afford one :) )...

Re: H1B->Green Card

It may be odd but it's true. The cut-off is one year before your six years in H status expire. Your employer will have to file annual extensions for your H-1B until your application is decided.

Re: California Driver's Licence / resident

My reading of the California DMV website is that you are eligible. (Of course, you may have to retake the test.) And yes, you should get one. Read the DMV website for information about what documents...

Re: H1 transfer

Both are right. The law allows you to work upon receipt of your transfer by USCIS, but it's always safer to wait until USCIS actually believes they have received it. For instance, on my original H-1...

Re: When to surrender I94W? (Flight UK-US-CA-UK; Day Trips from CA

Amtrak passengers are processed at the border, which is Rouses Point, NY, so that's no good. There are two possibilities I can think of:
(1) Drive down to the nearest border crossing, probably...

Re: F-1 to permanent residence--doable?

So far as I understand the law, the provisions are that only the parents get a Green Card; their children get nothing.

Of course,...

Re: entering usa on british passport/canadian citizen

I would think that you'll have no problems entering the US, but you might have trouble getting back into Canada. If you have no return or onward ticket, and you live in Canada, but you have no proof...

And of course I hate to mention them, but there's ... easyCar. Minimal service, gotta prepay, lots of paperwork ahead of time, but nobody would rent me a Zafira (or similar-sized car with enough room...

In Massachusetts there's going to be a sales tax holiday (for pretty much all goods) on August 14th -- but I've seen almost no publicity about it. I suspect a load of retailers just won't do it...

Re: 1130

First of all, remember that you don't qualify for a visa yet. Only applications filed before October 2000 qualify at the moment.

That said, all the Service Centers except Vermont are processing...

Re: Wash Post: Tenn. Creates Immigrants' Driving Permit

I'm glad I don't live in Tennessee (or Pennsylvania, where it's even worse -- if you have less than a year left they won't give you a license at all, which isn't helpful for people whose status is...

Re: Best time to get married

Before you submit your I-485.

To expand, if you're an H-1 and your fiancee isn't in the US, you should marry her, get her an H-4, and bring her to the US. Once you're both here, submit your I-485....

Re: Changing jobs with EAD (I-140 not approved)

Unfortunately, no. 180-day portability only applies with an approved I-140. If for some reason your I-140 was approved but your I-485 was delayed, then you could use portability. But that's unlikely...

Re: GC job description and EB2 question

You'd be better off filing as EB2. Why? Because PERM is coming, and I've heard it said that when PERM comes, there could be a run on employment-based visa numbers, such that there's a delay in...

Re: A question about Dual Intent Doctrine

Well, yes and no. If you enter using the AP (and don't have an H-1B visa stamp), you're paroled -- you're not in H-1B status any more. However, INS/CBP/USCIS/whatever they're called this week have a...

Re: H1-B Visa Holder - Visa Extended - Urgent question

The problem is that the whole visa revalidation service dies on July 16th, and they refuse to put a visa in a passport that expires in less than six months.

If you can get your passport renewed at...

Re: RIR vs. PERM for Labor Certification...

If you have already done the recruitment and proved there is no American ready, willing and able to do the job, I suggest you file RIR now. Reasons:
(1) It's free. It's rumored that PERM will cost...
