Re: Can UK citizens get a US visa vfrom Australia?

Usually you can only "use" the embassy where you reside -- so if you are just tourists in Australia, you probably cannot apply through there.

It doesn't hurt to email the US embassy in Australia...

Re: CR, divorce and remarry same spouse Question

Here's my guess...
- File I-751 now with waiver of joint filing requirement (since divorce from marriage #1 is final s/he should not have to wait until ~Apr 2008)
- File with all the bona fides up...

Re: Immigration difficult for struggling family

Agree with Rete here. Don't go jumping to conclusions about meeting the new fees just yet, let alone lawyering up. This could really be a lot easier than you think!

Re: How long can I be outside US using Advanced Parole? (

My husband was outside of the US for 87 consecutive days and was let back in on Advance Parole. We were traveling so were constantly on the move in different countries -- which IMHO is very...

Re: Applying for Tourist visa for parents while their I-130s pending

No, no rule that says you can't have both going through at the same time. Many people are able to visit the US using VWP or non-immigrant visa while their I-130 is pending. Problem is that when...

Re: How to avoid the 2 year return policy for J1

That's what we were going to do as well, although in the end we decided not to have a larger wedding ceremony after all. Instead we had a nice, very private civil ceremony at town hall. We still...

Re: How to avoid the 2 year return policy for J1

I'm kind of confused about what you posted here. But here goes:
Indonesian consulate would give you a "no objection" letter or statement. That would "waive" the 2 year HRR and make her eligible to...

Re: How to avoid the 2 year return policy for J1

AFAIK, if you can obtain a no objection statement, you're good to go. No HRR and free to adjust status. Since hotel housekeeper doesn't sound like a government sponsored program, from my layman's...

Re: USA vs. UK marriage

I wanted to offer a different viewpoint on gaining citizenship before moving on to the other country. For US citizenship, at minimum that would mean living in the US for 3 years. Realistically it...

Re: Applying for Tourist visa for parents while their I-130s pending

You could, but that is precisely the reason why the consulate may not want to grant them tourist visas.

Re: C-1 US/ Citizen Marriage

That is only one of the exceptions. There are others. People who entered on transit visas are also not allowed to adjust status. As are J-1 visa holders subject to the 2 yr HRR unless they serve...

Re: Please Help C1 Status In-transit/Marriage to US Citizen

My understanding as well.

I wonder if they could do an in-country waiver.

Re: Winning US Green Card doesn’t seem to help…

You're right. Winners of the DV lottery need to have maintained legal status in the US, otherwise winning does them no good.

Re: I-130 petition for a parent with child

Yes, when your petition's priority date comes up, assuming she maintains legal status that entire time.

Or marriage to a USC.

Re: advanced parole

Even though there are only two choices, IMHO it's inaccurate to characterize it as a 50/50 chance. Far more people are let in with AP than not let in. It's probably closer to a 99%/1% ratio... not...

Re: I-751 Affidavit question

Affidavits are not required, but you may include them if you wish. Have them notarized if you use them.

Other types of evidence are essentially the same things you brought to your AOS interview...

Re: I-130 petition for a parent with child

Your sister will not be included in the petition for your mom. Your mom is the immediate relative of a USC and will have a visa number available to her immediately -- meaning she can come pretty...

Re: Marriage in the US and return to UK

I quoted you what the US consulate website (UK one) said in post #3. They said VWP is the appropriate "visa" to use for your purposes.

Re: returned i-131 / missing parts

Given that it's probably not that difficult to find another photo and print out another letter, I would err on the side of overkill and send everything over again.

Re: First brush with US healthcare system

The lab charges are always the craziest and biggest disparity for some reason. I frequently get "explanation of benefit" statements saying that the lab's "rack rate" is $661, insurance's "negotiated...

Re: Cultural differences between USC (or other) and UK spouses

Definitely illegal to ask about how old you are at a job interview, that one's been pounded into me by HR. Pretty sure it's illegal to ask about marital status and children as well.
