Do you have your EAD in your hand already? If yes, you may want to check with an immigration lawyer about AC21 and using that as a basis of green card with the new employer.

The company is right, they can't just transfer the visa. This is an I-129 petition which results in a 797 approval notice. I presume this is what you took to the embassy to get the visa. This is on...

You're completely right Ian. On paper, yes "just" need to be an extraordinary biostatistician :-)

However, atleast in the industry the ratio of PhD biostatisticians vs the rest is highly skewed...

Do-able if everything goes well. What if there's an RFE ? What if embassy puts your application for additional processing? What if the passports aren't back in time? What if the courier misdelivers...

yes - my mistake. Looks like they'll admit you for three years irrespective of the dates on visa or I-129S if it's an initial admission, provided the I-797 blanket is still valid.

In that case your I-94 end date will be based on the I-129S that you got back from the consulate.

It's I-797 and not 757.

I-797 has a validity from and a validity to period of three years. What is that validity to date? They won't issue an I-94 past that valid to date.

She came in 2007 (was this the L-1B blanket petition) and then she filed an extension with USCIS in 2010 and you guys went to embassy in 2011, but this wasn't a blanket right? In 2010, the US embassy...

One of your previous posts you mention that it was a blanket petition for your wife, so what does your I-129S say ? Which box is checked, Manager/executive or special knowledge ? That is her status....
