I am willing to consult and pay for a lawyer - But only if they can give me definitive answers. I haven't really seen situations similar to mine discussed online, which kind of makes me question 1)...

Also, all in all it does feel like that the very grey nature of what I'm asking will draw some scrutiny if I try to visit via VWP - At least if I put in the time and effort of doing a visa...

Actually, I'm still here. I'm still not confident with any of the advice I have asked for so far, and then my employer wouldn't give me annual leave this Christmas anyway. I'm going to try to go next...

Thank you for replying so quickly. But I just wanted to clarify that when I register with ESTA, I don't have to say that I overstayed? And could you point me in the direction of a website or document...
