We are in US currently on our EADs issued through the pending I-485 (under EB-3). Hence, we are not sure if requesting a "conversion" might put us out of work status for a short period of time?

Our I-526 was approved today (after a very long wait).
Currently, we are in US as our I-485 is pending under EB3.
Now the question for us is whether it is better to transfer existing I-485 from EB3...

It is indeed a relief that we are at the next stage after 1 year and 4 months of wait for I-526 approval.

- We already have a I-485 pending under EB-3. Should we try to move this one to EB-5 or is it better to apply for a new I-485...

I hope you are correct. Everytime I ask them, they tell me that a decision is forthcoming. The wait has been very distressing.

I talked to our attorney about potentially looking at switching projects and they said it is better to wait for an outcome at least. Given that we have waited so long, it will be worse if USCIS...

You are correct. The project got 3 approvals within first 5 months and that is what got us hopeful but after that they issued an RFE and all cases have been pending ever since.

I applied for I-526 in mid Aug. We have not heard anything so far apart from the initial receipt. The USCIS website says that the avg processing time is about 5 months...
