Re: E-3 Visa for Australians Thread- It's all in here

For short trips of 30 days or less, to Canada, Mexico or adjacent islands excluding Cuba, it seems you can re-enter on your I-94: 22CFR41.112(d)...

Interesting read thanks for sharing and congrats on getting your extension :)

I'm in the middle of changing employers via USCIS right now. Filed on June 30, accepted by USCIS on July 9, RFE sent...

Re: E-3 Visa for Australians Thread- It's all in here

I tried searching on this but I'm yet to find anything conclusive. I did find some interesting links though. It seems even for some attorneys it's a topic of debate.

A decent read:

Re: E-3 Visa for Australians Thread- It's all in here

FWIW our case was received by USCIS received on July 9 and they just sent an RFE yesterday, October 25. So that's 3.5 months so far (really, 4 months since we posted it)

I'm not sure what they're...

Re: Calling USCIS when a case is pending longer than usual

Still waiting over here :/ The last update said Vermont was up to June 18 and California was up to June 4. That's as of August 31 so you'd think they'd have picked yours up by now. I recall reading...

Re: Changing Employers on an E3 Visa

To the best of my knowledge, no, you are not obliged to tell your current employer that another company has filed a petition to employ you. But you will obviously have to tell them at some point :)

Re: Visa shuffle – which would suit best?

That's not necessarily true. At least one work visa (E-3) is designed such that the visa fee transaction is between the US and the employee, and there need be no legal fees.

Even when the company...

Re: Calling USCIS when a case is pending longer than usual

Yeah I've heard that as well, I think from ian-mstm, good advice and I've managed to keep it to once a day m-f too. Still drives me nuts though :)

Re: Calling USCIS when a case is pending longer than usual

Oh cool so it sounds like calling them may actually be helpful. I'll give it a few days and hit up my employer to give them a call. Thanks for the info!

Re: Calling USCIS when a case is pending longer than usual

I have checked online, yeah. It's only 1 day later than the national average and it's not a premium processing case as that's unfortunately not available for E-3. I understand it's only been a day...

Re: Calling USCIS when a case is pending longer than usual

Bummer! What are you applying for out of interest? E-3 I-129 CoE here.

USCIS.gov still says 2.0 months for my category as of June 30 but the trend graph (http://i.imgur.com/XMoNF.png) doesn't look...

Calling USCIS when a case is pending longer than usual

The USCIS website says we can call customer service to check on our case status if the application is pending beyond the usual processing times. My case now fits that description, for a total of 1...

Re: E3 visa holders

The E-3 is much cheaper and easier for the employer than H-1B because they are not required to submit a petition and it's much less competitive. The yearly quota has never been reached.

There is...

Re: E2 visa. Please help

Depending on the type of side-work you're considering, could you somehow spin the side-work as a product/service of your E-2 business?

Re: E3 Visa Processing Times-the REAL Ones based on Your experience

In the past couple days, the processing time for H-1B I-129 at VSC has jumped from 2.0 months to "April 16, 2012" (aka 4.0+ months).

The E-visa sub-type still says 2.0 months but they obviously...

Re: E-3 Visa for Australians Thread- It's all in here

Hi

Am I likely to run into problems if I go and get a new E-3 from a consulate while I have an I-129 pending for the same employer/LCA?

The I-129 is apparently going to take 3-5 months and no...

Re: E-3 Visa for Australians Thread- It's all in here

Ah OK. I actually already have an approved LCA for an August 1st start date because the lawyer thought premium processing was available for E-3 I-129. So the original plan was to wait for I-129 to be...

Re: E-3 Visa for Australians Thread- It's all in here

Thanks for the answer! I'd actually totally prefer to do it at a consulate. The part I'm stuck on is, how do I get it approved before announcing my resignation? Or are you saying I could leave the...

Re: E-3 Visa for Australians Thread- It's all in here

I like my current employer and I want to minimize the inconvenience. There would be a very real difference if I was to give zero days notice as opposed to four weeks.

Assuming I hated my employer...

Re: E-3 Visa for Australians Thread- It's all in here

Logistics of changing E3 employer from outside the US?

Hi all,

I am in the USA on the E-3 and I am in the process of changing employers.

I need some help deciding whether to change status via USCIS or hop out of the USA briefly to get a fresh E-3....

I'm not sure actually, as I'm relaying through my prospective employer. Do you think there may be a chance it's not needed?

I went ahead and posted off forms requesting replacement documents from...
