Re: Processing times for I-140s

Oh thanks - yeah I did mean 2013! There's so much hype about "2012" that I kind of forget sometimes that there's a year beyond it.

Processing times for I-140s

Last time I wrote here was before Christmas, when a previous attorney refused to give me documents from my old O1 case (he said he lost them). So, my current lawyer and I filed a FOIA request to get...

Mental Questions for Visa

I'm about to start treatment for Bulimia and as this is considered a "mental" illness (I will be having psychotherapy), I was wondering if this will affect my visa applications. I know they ask about...

Re: Former attorney will not give me back evidence

It's just really disheartening. I need one letter from the evidence I submitted. Now it's going to hold my petition filing up for at least six weeks.

Re: Former attorney will not give me back evidence

Hmm yes it did seems strange. After all, if it was a genuine error then they've had months to tell me instead of promising me files. And, I requested the files months before the supposed 'crash', so...

Re: Former attorney will not give me back evidence

So...I offered to pay for the return of the material (I basically said name your price - it's urgent!) and they came back and said:
"Sorry, we lost all of your files as they were computerized and we...

Re: Former attorney will not give me back evidence

Okay, so I'll call on Monday and ask if it's been sent yet. If it hasn't, I will assume that it never will be, like past attempts. I will then offer to pay for it to be returned and that I need it by...

Re: Former attorney will not give me back evidence

I paid the original attorney. I asked my current attorney if he could ask the former attorney for them, he said that's not something he's allowed to do.

Re: Former attorney will not give me back evidence

I kept nearly everything, but it was about 3 years ago and I've moved to the US and back twice during that time. I think I have everything with the new lawyer but there is one letter in particular I...

Re: Former attorney will not give me back evidence

Thanks for your responses!
I'm in the UK and he's in the US which makes it difficult to turn up at his office...otherwise I would have done that by now!
What information is contained in the stuff...

Former attorney will not give me back evidence

I obtained an O1 visa from one attorney, and am now using a different attorney for my EB1 application. I am so close to filing but need some things back from my O1 case. I have called, emailed and...

Re: Filing taxes and background check

Thanks, yes I guess at least I managed to sleep at night.

But just out of curiosity, if checks weren't made (and I get the impression they aren't made frequently), how would it affect future visa...

Re: Filing taxes and background check

Gosh, I have to say I'm a little amazed by that. Back when I was living in L.A I was offered a couple of jobs as a waitress/hostess, but turned them down even though I really needed extra income. I...

Re: Filing taxes and background check

Oh, ok.
So how do they keep an eye on what people are doing? I mean, I have friends who are working jobs as bartenders and even one who is working in Starbucks (on an O1 for acting). Are checks ever...

Re: Filing taxes and background check

Ok, so how does that link in with USCIS? How do USCIS check that I'm not working outside of my visa classification if the IRS don't record my job title?

Re: Filing taxes and background check

Hi, thanks for your reply.
I do have a SSN, I've had it since 2006 when I studied in the U.S., and gave it to the company I worked for.

Filing taxes and background check

Hi,

I don't know if this is the appropriate place to post this, but I cannot find any information (that makes sense) anywhere else. I seem to have a mental block when it comes to taxes. I just do...

Changing my name when in the process of filing a petition?

Another question from me I'm afraid...I've searched for this on the internet but I'm stumped :(
I want to drop my last name and just go by my first and middle name. As an actress I've been doing it...

Re: 01 visa to Green Card?

The EB1 is so complicated, you need to talk to your lawyer. It varies so much case to case and everyone is so different. Only your lawyer can give you accurate advice. Don't worry about AOS and dual...

"As far as I understand, the O visa is NOT dual intent. That doesn't mean you can't progress from it to a green card but you have to be careful. For example, once you have lodged your Adjustment of...

Re: 01 visa to Green Card?

Once you have an EB1, it takes five years (I believe) to be able to apply for US Citizenship, so really, it will be a USC petitioning them?

Re: 01 visa to Green Card?

Yes. It is dual intent. It depends how long your attorney needs to prepare your case and whether you do Premium Processing (a 2 week decision - see my other posts about that).

I wasn't aware that...

Re: O-1 VISA Help!

Oh, and you definitely don't have to be in the US for five years before applying for an EB1, where did you hear that? I'm doing mine before my 3 year O1 is expiring but you don't even need to have...

Re: O-1 VISA Help!

Oh Ian no I definitely meant any acting job! Sorry should have been specific.

There are a couple of reasons why studios are turning away O1s. A Google search can tell you quite a bit :)

Re: O-1 VISA Help!

You can do any job; although be very aware that many, many studio's are turning away people on O1 visas. Not technically allowed, but it's happening.
