Re: H4 to EAD via wife's H1B - Still Confused

Thanks for correction.

Right, this is the "procedure". Immigrant visa issuance at the embassy is same as adjudicating the I-485 case. In both cases they consume immigrant visa.

Re: H4 to EAD via wife's H1B - Still Confused

You can also get Green Card by Consular Processing which is when you do not...

Re: H4 to EAD via wife's H1B - Still Confused

A priority date is current when USCIS say it is current in their bulletin OR when your PERM file date is earlier then the priority date in current visa bulletin.

You have good memory and...

Re: H4 to EAD via wife's H1B - Still Confused

When date is not current and I-485 is pending at USCIS, they give you EAD/AP (obviously you have to apply for it) so that you can work and travel while your case is in process.

When date is...

Re: H4 to EAD via wife's H1B - Still Confused

If you mean I-485 by "GC application" then you don't have to be on H4. You can apply for EAD.

My guess is, you filed I-485 when everyone was current in 2007 and then it backlogged.

Re: H4 to EAD via wife's H1B - Still Confused
