I NEVER heard of something like this...However, everything is possible. However, I would KINDLY advise you to call INS-Customer service or talk to a lawyer before the child's birth.

It depends where did the company filed the H1B request...it depends on the INS processing center. Usually it takes 3-4 mo., but, now....only God knows!!!!
