Re: Filing I-751 prior to conditional expiration: still married, but pending divorce

Thought I'd give you an update on my situation. I filed on June 10, and got my one-year extension a few days later. I then went for biometrics in Detroit two weeks ago.

Today, I went to check my...

Re: Filing I-751 prior to conditional expiration: still married, but pending divorce

Hah, just when I am confident and ready to file you throw a wrench into the works Rene ;)

To my knowledge, the 2009 memo stated that if you're still married (regardless of whether or not you're...

Re: 1751 waiver

I'm sorry to hear of your situation fizzapal, it seems like your ex was quite the nasty person. Which service center did you file the I-751 with?

Re: Filing I-751 prior to conditional expiration: still married, but pending divorce

Part 2 of the I-751 gives you the a list of options. There is no option to say you are still married but filing separately. Of the remaining options, (spouse deceased, divorced, battered, battered...

Re: Filing I-751 prior to conditional expiration: still married, but pending divorce

We're not divorced, so I can't file good faith yet. The only option I see is extreme hardship, citing the loss of my daughter. I imagine anyone with a brain would see this as a legitimate hardship...

Re: Filing I-751 prior to conditional expiration: still married, but pending divorce

My blood pressure is high :D So Ian, you would suggest just listing the addresses and not explaining the reasons for those changes? And what about the question that asks if your child lives with you...

Re: Filing I-751 prior to conditional expiration: still married, but pending divorce

Ok not to drag this out anymore, but I still have some serious concerns. We both live at separate addresses, so have to state this on the I-751. And as for disclosing the condition of the marriage, a...

Re: Filing I-751 prior to conditional expiration: still married, but pending divorce

Well thanks for the honest responses! I'm just very nervous and cautious about the process, I hope you understand that. I stand to lose so much in my daughter hence why I'm trying to cover as many...

Re: Filing I-751 prior to conditional expiration: still married, but pending divorce

So I came across this interesting discussion of a person in a similar situation to me. Suffice to say, it's got me worrying again. Of particular concern is what one poster says:

The drawback would...

Re: Filing I-751 prior to conditional expiration: still married, but pending divorce

Hmmm you do raise some good points. What about affidavits though? It's gonna be hard to get people to write about the relationship without them mentioning our issues right? Would it be advisable to...

Re: Filing I-751 prior to conditional expiration: still married, but pending divorce

I just want to be completely honest - it seems naive to assume I can send the app without discussing our problems and not have them investigate. What if they called us in for an interview and we...

Re: Filing I-751 prior to conditional expiration: still married, but pending divorce

Hmmm so I could just file jointly? There isn't anywhere on the 751 that asks for explanation of the current marriage situation, although I have every intention of discussing that in the supporting...

Hi all,

I am about to start filling out the I-751 as I'm now within the 90 days of my conditional GC expiration. I am still married, but we are likely to finalize our divorce within the next...

Re: Divorce Looking Imminent :-(

A dissolution is the 'no fault' way to end a marriage in Ohio. If I went with fully-blown divorce, I would have to state my case on one or more of the following faults:

Either party had a...
