Re: Marry then I-130 or I-129 and Marry

Wait times for both visas (K-1 and CR-1) are roughly the same. Around 12 months-ish.

The CR-1 will give you permission to work from Day 1 in the USA, if that's a driving factor. Plus you become a...

Re: Marriage - Moving from UK to USA

Well, I can't find what I thought was out there. The sites all say now that a K-1 visa holder doesn't have the right to work upon entry to the USA, and must apply for an EAD.

Huh. I guess times...

Re: Marriage - Moving from UK to USA

I'll see if I can poke around and find something. I also did it so long ago, I've lost track of where I've seen things. It's something like "inherent right to work for the first 90 days in the USA".

Re: Marriage - Moving from UK to USA

It's odd, I know. The K-1 visa is not one of the acceptable docs on the I-9 verification form. That's why, even though the K-1 holder has the right to work, it's tricky to find an employer who...

Re: Marriage - Moving from UK to USA

My understanding is that the K-1 visa holder has the right to work for the first 90 days after arrival, they just don't have physical proof of that right (in the form of an EAD). So they need to find...

Re: Immigration / Usa living

Hi and Welcome to BE.

In order to live permanently in the USA, you must have a visa that allows you to do that. If you are not planning to work, that leaves a work visa out. If you don't have...

Re: E2 investment visa

The value of the information on this forum comes from people who might have "been there, done that", but it is definitely not legal advice. Proceed at your own risk.

Re: Help

I see from your other posts that you're in the USA for 4 years and have a green card. Thus, since your questions aren't about how to immigrate, I'll move your post to the general USA forum.

Re: Help

That's pretty vague. Do you have at least one specific question to get the ball rolling?

Are you currently inside or outside the USA?

Re: E2 expired

So you plan on entering in a B visa, but then not do your regular work, right? Because that's not allowed a a visitor.

Re: Is there an online marketplace for USA British expats?

Facebook marketplace is also big on scammers lately, too. I used it about 8 years ago to sell a lot of my home furniture and it was great! Last year I tried to use it again for similar purpose and...

Re: Working visa in Canada - but applying for US GC

By the way, your thread title says "applying for US green card". But you'll really be applying for a spouse immigrant visa, CR-1. Just make sure you're researching the right process.

Re: Working visa in Canada - but applying for US GC

The long part is from filing the I-130 to the point where you can make an interview appointment.

Re: UK/US Companies that sponsor immigration visas

Such a list wouldn't be helpful to you unless it was broken down into specific jobs.

What is your current job and how long have you been doing it? What field is your degree in? What level of...

Re: E2 Visa Process from beginning to end?

I think the OP was including the waiting time to actually get the visa.

Re: E2 Visa Process from beginning to end?

You could start both the E-2 and K-1 and use whichever comes first (keeping in mind you have to be ready to marry within 90 days on the K-1) . You are allowed to have multiple petitions and processes...

Re: E2 Visa Process from beginning to end?

Just a side note, if you end up getting an E-2 visa, once you are in the USA on it, you can marry and apply for Adjustment of Status to Permanent Resident. No need for the K-1 visa.

Re: Dual Cad/UK citizen marrying US

Getting married in the USA can be done in one day (like in Las Vegas, for example), and can be done as a visitor in the USA.

After marriage, the USC files the I-130 to get the ball rolling on the...

Re: Mental Health and waiver of ineligibility

As suggested in your other thread, your case is complicated, and the suggestion is to consult with an immigration attorney on how all this will affect your visa process.

Right, and plus if they are just at the filing I-130 phase, it's definitely not required.

Each new application is considered a brand new application, regardless of past applications. You've done the right steps, now you go to the in person interview and follow the next steps. You can't...

Re: Applying for AOS for Parents of A US Citizen from within US

There's no way to apply for sibling's AOS until a visa number becomes available (i.e. 17-ish years) AND the sibling is legally inside the USA at that time.

File the I-130 now, to get the ball...
