Spain's Finance Ministry has recognized the right of fathers to take statutory breastfeeding leave in certain circumstances. An agreement to this effect with the public-sector union notes that the terms for paternal breastfeeding leave would also be extended to the private-sector workforce under the Workers' Statute. The European Court of Justice had earlier notified the Spanish government that restricting the leave to the physical act of breastfeeding is discriminatory because any leave time for caring for an infant should qualify. The right would be transferred to the father only in cases where the mother is too busy to take the breaks.

Yes I know the women can express the milk but this is not mentioned, the issue seems to be surrounding the fact that women can take breastfeeding leave and men can't, and that this is discriminatory...

(And in agreeing with you) WTF's wrong with discriminating? In many instances the opposite of "to discriminate" is "to be indiscriminate", not "to be fair". Surprised nobody's mentioned Reg yet.
