Someone has just bought our villa
 
So this Emirati dude, very nice and friendly came to inform us that he's just bought our villa, asked how long we had left on it and when the rent was up,

now we've only been in 6 months, need to check the lease as what happens if we want to stay? Does the rent stay as it is and do we get a new contract or would we have to speak to this new guy and pay more? :ohmy:

Stay where you are, and at the current rental level too - everything is in your favour.

Is he seriously suggesting that he went ahead and bought the place without checking those details??

He is probably hoping that you are stupid and don't know the rent law...

''I am sorry, your old contract with old landlord. I am new landlord, your new contract is aed260k one cheque. I come with contract and you sign tomorrow and give me cheque.''

how does it work though? does he have to keep the rent at the same price for the next 2 years ir something?

yes your rent can't go up for the first two years, if he wants you out tell him you will take him to the Rent Committee. Things have changed a bit recently though BB2 knows more about it that I do. Apparently if they can prove that they want to live in the villa they can actually give you three months notice to leave. (don't quote me on that). Stand your ground. Fancy buying a villa that you haven't even seen!! wonder how much he paid for it :confused:

I thought that when a new landlord appeared it kind of changed the rules...

New landlord has to honour any existing rental contract, so you are protected by the rent law.

It's possible he acquired the villa in lieu of debt owed to him by the former owner.

Or that the former owner defaulted on his mortgage and the bank sold the villa..?

Plenty of bargain hunters out there waiting for someones credit to snap...:huh:

nah the landlord (old one) was part of about 6 guys who owned a stack of properties.

it doesnt matter if its a new landlord, he has to honour the contract that you have. dubai is a little different to ab dabs, as we have increases every year, but in dxb you only get an increase on 3rd renewal. basically same as before, but if he says he needs it for personal use, it has to be for immediate family only, not cousins 10 times removed etc, and he has to give you notice 90 days of this. 30 days notice of any change to your contract, ie rent increase which they never do...! you should be allowed to stay in house for 3 years, but dont bank on it, this is happening a lot now, more so i would say in ad than dxb, as the rules dont mean anything, they are not meant to increase past the rent cap etc, but they do, they are not meant to evict you but they do, etc etc. but it does help to know the rules. for eg: first renewal (new house) eviction notice for family personal use, in the end negotiated another year, signed a non renewal clause, (with arabic clause written in it only to give back for personal use...!) and 25% increase... yeh cap is working, not in ab dabs.
