well they put me on permanent freelance, so the others have buggered off and I'm stuck here as I get paid by the day, doing my portfolio and stuff and getting 'sad eyes' from everyone as they know I'm leaving soon.

I'm gonna have a word and see if they'll pay me and let me leave next week.

technically if they are paying you off due to the recession you should have been 'let go'' the day it happened.

but why bother, they don't want him on the team anyway so pay the lad and let him get on with finding something else. Agreed different rules here no doubt but normally you are out the door ASAP regardless.

It doesn't work that way. Every contract has a notice period and it is up to the company to decide whether to allow you to leave and pay you for the notice period or make you work it. In the second case, you can usually choose to work your notice or not, but you will only get paid up until your last day. So why not stay, earn money, use the facilities and look for a job?

Oh yeah and they can do this in the UK. They just change the job spec slightly, give it a new title and bring their mates in.

that does leave them very much open for a wrongful dismissal claim though.
the courts will not look at the job title they will look at the job itself
