Employment law in the UK is actually quite clear on this: Any employer can let go any employee (without even giving a reason) in the first 12 months (there are a few exceptions to this but none that would apply in this case). All the employee is entitled to is one week's statutory notice period/pay.
I had a case at the CAB once where someone had been offered a job, had accepted it, signed the contract and been given a starting date. A few days before the start date, he was called by the manager and told he now no longer had the job, because head office had decided to close down one of their places in the next town and the local boss had then decided that the job that was to be given to the new guy was to be given to a guy from the office that was closing down. New guy 'phoned us at the CAB to find out if he had any rights re breaches of contract etc etc. But as a new employee you have no such rights. You are entitled to one week's pay as your notice pay, but that's it. (If the job contract says that right from the start you are entitled to x week's notice ("x" being more than one week, then you can claim that as your notice pay.) Gina (ex CAB worker) |

Bad news on the job front :( however since Sept 11th I guess they have tightened up on the hiring policy for people who do not have a 3yr checkable background from within the UK.

What a bummer for you :thumbdown: There are work-arounds in some cases. Depends on the circumstances and the original poster will have to explore these on own initiative. |

Well, it appears i shall be getting a small compensation from the company anyway.
My friend on the "inside" had to go into her office yesterday morning and there was a letter on her desk from her immediate superior (the guy who gave me the job) In it he stated how sorry he was for the way i have been treated and he wants me to go in to see him on Tuesday so he can explain what has happened to me and he intends to offer me a months salary as an appology. Better than nothing i guess. Just need to find another job ASAP. |

You should apply for a job with the Home Office. They not only employ immigrants but illegal immigrants as well. The only problem is that you may be too white and too english to get offered a job.

To say i am mortified is the understatement of the year. On Monday after receiving and signing my terms of employment, being cordially welcomed aboard by letter and truning up for my first day in my new job, i was shiffled into the managers office and told that there was a slight problem and i may not be able to start training that day due to not having my security clearance sorted. I was told it was just a hiccup and to stay with my new manager (she is also my best friend who got me the interview for the job) Later in the day i was told to go home and stay home for next few days while they sorted it all out and bot to worry as i will still be on full pay. All week i have been biting my nails because my friend told me that there was a big issue because i had lived outside the UK for more than 3yrs :confused: Even though i am a full British citizen. born and bred, never lived anywhere else before this, apparently i am NOT allowed to work for the MOD !!!!!! :confused: :ohmy: My new boss was also furious about it and promised to fight my case for me right up to the top commander at the base. Anyway, all this was to no avail and this afternoon i was told i no longer have a job. :blink: :( I am devastated. I had all my new contract sent off to my husband in Sydney to add to his visa application saying i could support him until he found work. I had made plans to move over to my other daughters house which is very cose to the MOD HQ. I had even bought myself a new bed to put in her spare room for myself. I feel as if my whole world has collapsed around me. After nailing this job, i really felt as if all our plans were falling into place and i could start planning getting hubby home with me. My friend is outraged and feeling very bad about the whole situation. She also told me over the phone that i should not take this lying down and i should sue them, but i am not sure how i would stand in all honesty. She feels they are in breach of their contract to me because they offered me the job and accepted my signed contract etc, and even set up my payroll number in full knowledge of my situation and the fact i had only just arrived back from Australia after several years out of the country. I really dont know what to do next, apart form look for any old job to get me by. Does anyone think i would have a case to sue them or is my friend just shooting from the hip in anger? Good luck.
