US Born Children Living In India
 

Dear All, I have 2 kids who are born in the US and have US passports. My spouse and I aren't US Citizens or Green Card Holders but have lived in the US legally (yes, always). We are relocating to India (our home country) in a few months and I had the following questions. Could you please share your experiences?

- Can the kids live in India until they turn 18? They have PIO (Person of Indian Origin) cards we got from the Indian consulate in the US but it says PIO holders can stay in India only up to 6 months. I'm sure there is another way since I've heard many people with US born kids live in India peacefully (at least administratively :-)).

- How easy/difficult is it to renew their US passports in India at a US consulate?

- Do the kids return to the US before they turn 18 to continue their US citizenship? Once they affirm they want US citizenship (when they are 18), can they move back to India, if they want?

- Will the kids be treated as NRIs in India?

PIO card allows a longer stay than 6 months as far as I know, subject to registration.

Or what about Overseas Citizen of India?

Their U.S. citizenship is valid for life. They should always use U.S. passorts, and when of age (around 18) they need to file U.S. tax returns even if they don't need to pay anything. If male, they must register with Selective Service : http://www.sss.gov
