Recategorise rustic land - best route to take?
 

Hi. My land in Almancil did previously have building planning permission but this lapsed and now is categorised as "rustic" land. Can anybody recommend on steps to take to apply for the land to be recategorised back to having planning/building permission please? If a professional body is required, please help by providing contact details for a good, reliable, honest
and English speaking representative. Many thanks in advance.

The categorization of the land is shown in the PDM (Municipal District Plan) and anyone can go along to the council office and ask to take a look at it. You can ask a Technical Draughtsman, Engineer or Architect to submit a feasibility request to see what happens with it but that will cost money. If it were easy then everyone with a plot of €6 euro per m2 agricultural land would be doing this and making money ! Once permission has lapsed its good for planting a crop of beans or keeping some chickens on - unless the PDM changes and just happens to re zone your bit! If you have a ruin on the land then there may be better news.

I don't know if this is of any help but when we bought our house, we were quite worried about the land next door to us because if anyone built there it would detrimentally interrupt our view. It was classified as rustic land. We asked our lawyer to give her opinion and she seemed to think the only way planning permission would ever be re-instated was if there wads a major overhaul of land policy or a massive political change. We bought the house on this basis but we did contact the family who owned the land and we managed to negotiate purchasing it..... we know we paid over the odds but it's worth the peace of mind. We were also offered another rustic piece of land whose permission had lapsed and again, the opinion was little or no chance of the permission being restored.

We are quite rural so this might be a consideration.
