Re: Portuguese Passport Through Marriage
This came from the Portuguese consulate in the Washington DC website: Through Marriage – Embassy of Portugal
However, the other consulate website (San Francisco) says something different: https://www.portugalinsf.com/consular-services/
I'm just going to start with the apostilling and translating and gathering and will worry about language/links to culture later. The person my OH spoke to at the consulate said it had taken three years to get all the necessary documents together for her husband's citizenship. Gah.

Re: Portuguese Passport Through Marriage
Cracking on with the Passport app:
- Police certificate from all countries I have lived in since the age of 16 acquired and apostilled, except FBI certificate which needs to be less than 6 months old. Will translate all at the same time.
- Next step have the OH register the marriage in Portugal when we are there in the next few months and then get print out of his citizen record (which contains an entry noting our marriage apparently).
- Links to Portuguese culture: photos/receipts of holidays in PT, nights out with local Portuguese group, membership to local Portuguese society, attendance at local Portuguese events.
... the only thing that is giving me sleepless nights now is the language requirement and mostly because I can't get a straight answer on whether it's actually an issue or not. Can anyone share their experience on this point? I will not actually be living in PT at the time of application.

Indeed. That's the easier part.
The harder is whether you're going to need to provide proof of connections to Portugal or to the Portuguese community, whether what you might have is sufficient and whether there'd be likely to be a requirement to prove proficiency in the language in your case.
You can find out by submitting what you have and the fee and risk forfeiting it or you can pay to get a professional opinion of your likely chances of success before you start the process and more on top to get them to see it through for you, presumably. Not an enviable choice and I fully understand your wariness with regard to that industry, although I don't know whether it's the same here in PT.

I have not followed this up as I am going to Portugal for the winter and am going tp start my application there.(hopefully avoiding the consulate).
I maybe wrong but i don't think you have to pass a language test if you are married to a Portuguese citizen.Perhaps someone can correct me if that's wrong.

Language test is not needed if your other half is Portuguese. That is the info I have been given. My Portuguese is getting along but not good enough to hold a conversation. Can read it enough to get the gist.
As far as applying for citizenship ... still have not gone further other than getting details of all the docs needed. Still unsure of what to do as we still intend to spend half year in Portugal and half in UK. Waiting to see what Brexit turns up.May go for dual nationality if still able to.

Thanks! Were you thinking of giving up your current nationality then as you note "May go for dual nationality if still able to." ?

It is hard to find a solution since every case has its own particular solutions. The best advice is to talk to a specialised lawyer. It may cost a bit money, but you'll be sure on what your doing. You wont waste time.

Also the latest stage of Simplex kicking in & other, simplified procedures such as PCRs no longer required for some processes.

Re: Portuguese Passport Through Marriage
Me again! I've gathered all my documents and am heading to the motherland soon. However, I'm now super confused about a couple of things. I'm currently in the US and the PT consulate has a list of documents necessary and some requirements for them that the actual application form does not state e.g. the Portuguese spouse's civil record printout must be less than 6 months old and note marital status, that all background checks must be less than 6 months old (all mine, except the FBI one are older than 6 months and it's going to be a nightmare getting them done and apostilled again), and that the marriage, if taken place in a foreign land, must first be registered with the Portuguese authorities.
The actual application form states:
- Certidão do registo de nascimento do cônjuge/membro da união de facto de nacionalidade portuguesa. (no date specified, and no need to have the civil state included)
- Certidão do registo de casamento (does not state that it has to be 'registered' in PT).
- Certificado(s) do registo criminal estrangeiro, emitido(s) no(s) seguinte(s) país(es) (does not state that they need to be less than 6 months old).
We can't even find out where/how to register a foreign marriage and my OH says his birth cert/civil record does not even have a section on it that notes his civil status.
Can anyone who has recently applied for citizenship through marriage and who were married outside of Portugal please let me know what you provided?
